The Scottish Government has confirmed that the Scottish Land Court and the Lands Tribunal for Scotland are to be unified to form an expanded Scottish Land Court. The decision follows a public consultation last year which recommended the amalgamation of the two bodies. We are told that the Scottish Government plan to bring forward legislation to enact the change during the life of this Parliament, subject to Parliamentary approval.
At times, the current the Scottish Land Court and the Lands Tribunal for Scotland have come under criticism for being slow and inflexible. It is hoped that the new Land Court will provide a more streamlined service with a more efficient arrangement than the ones currently in place. Any reforms that will make the process of litigating matters relating to property law simpler, clearer and easier to use must be welcome. We will watch the developments with interest.
