Online Payments
We operate an online payment portal (the "Payment Portal") to facilitate client invoice payments. Our Payment Portal is available to our clients only.
By making payment via the Payment Portal, you agree to the terms and privacy policy of the applicable third-party service providers terms. We currently use the services of Opayo to process payments securely.
Please ensure that you pay the correct amount. The maximum value that can be remitted via the Payment Portal is currently £25,000 (TWENTY-FIVE THOUSAND POUNDS STERLING).
When making payment, please enter:
- Your full invoice or reference number without spaces.
- Your full invoice amount without spaces.
- Your personal details as requested by the Payment Portal.
Any payments using the Portal take a minimum of 4 to 5 working days to reach our account.
We only accept the payment card types as indicated on our Payment Portal from time to time.
The Payment Portal can only be used in respect of invoice payments. It cannot be used to make other payments or the transfer of funds, such as a transaction settlement monies.
Our Terms of Business otherwise apply to our fees and payment of our fees.
It is your responsibility to ensure that payments are made by any specified due date for payment and that the correct information is entered by you when using the Portal.
Our responsibility for loss or damage suffered by you
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any advice to you, which will be set out in our Terms of Engagement supplied to you in relation to a specific instruction.
If you are a business user:
- We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
- We will not be liable to you for any loss or damage, whether in contract, delict or tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, our site (including the Payment Portal); or
- use of or reliance on any content displayed on our site (or the Payment Portal).
- In particular, we will not be liable for:
- loss of profits, sales, business, or revenue;
- business interruption;
- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation; or
- any indirect or consequential loss or damage.
If you are an individual user:
We only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Governing law and jurisdiction
Scots law will apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the Scottish courts will have exclusive jurisdiction to settle any dispute which may arise out of, under or in connection with these terms and for those purposes irrevocably submit all disputes to the exclusive jurisdiction of the Scottish courts. We make no warranty or guarantee that the site or information available on it complies with laws other than Scots law.
