Do I need a solicitor if my separation is amicable?

Where a separation is amicable, many couples are keen to keep matters as straightforward as possible. 

It is often assumed that if everything is agreed between them, legal advice is unnecessary. In reality, taking advice at an early stage can provide clarity, reassurance and legal protection, without introducing conflict.

Agreement does not remove legal risk

Even where there is broad agreement, the law in Scotland sets out clear principles for financial provision on divorce. An arrangement that feels fair at the time of separation may not fully reflect your potential legal entitlement under those principles, particularly if important factors have not been considered.

Understanding the full financial picture

All matrimonial assets and liabilities require to be considered carefully. This includes property, pensions, investments and debts. Missing or undervaluing an asset can be difficult to revisit later if legal advice is not taken early. Having a complete and accurate understanding of the matrimonial pot provides confidence that any agreement reached is properly informed, balanced and reasonable.  

Formalising the agreement

Informal arrangements are rarely sufficient. A properly drafted legal agreement, commonly known as a Minute of Agreement, allows the terms of separation to be set out clearly and recorded in a legally binding and enforceable document. This provides certainty for both parties and is often relied upon as the basis for any future divorce.

Avoiding unintended consequences

Well-intentioned decisions can have longer-term implications, particularly in relation to pensions, tax treatment, or future financial claims. Early legal advice helps identify and address these issues before positions become fixed or difficult to change.

Seeking legal advice does not mean adopting an adversarial stance. In amicable cases, the role of a solicitor is often to provide structure, reassurance and a clear framework, helping to achieve a fair and workable outcome calmly and efficiently. Separate, independent legal advice for each party helps ensure that any agreement is robust and less vulnerable to challenge in the future.
