In this blog, I share some reflections on what the work involves and what I’ve learned from working alongside the Family Law team at MFMac.
The team is highly experienced across all areas of Scottish family law including divorce, separation, international cases, prenuptial agreements, cohabitation agreements, civil partnerships, child law, adoption and family mediation. As a trainee, this means that there is a broad variety of work to get involved in. On an average day I might be drafting agreements or court forms, taking statements, corresponding with clients or taking notes at court. Things can move quickly, especially when it comes to court work, so being adaptable and able to think on your feet is essential.
I also obtained my restricted practising certificate, which meant that I could make my first appearances in court. Whilst nerve-wracking and daunting to appear in front of a Sheriff for the first time, I had been fortunate to have observed my colleagues and the advocates we instruct in court beforehand. It felt surreal to put on the gown for the first time. I don’t think the nerves or adrenaline that come with getting on your feet in court ever fully go away but I've found that the more I'm exposed to court work, the more enjoyable and rewarding it becomes.
A unique aspect of family law, in comparison to the other areas of law I've gained experience in across my traineeship, is that it is deeply personal. Family law in practice involves navigating complicated technical aspects of the law and emotionally complex and sensitive situations. As we often meet clients during some of the most difficult times of their lives, sensitive and pragmatic advice is paramount. This can be challenging but it is also very rewarding. Helping individuals to move forward from difficult chapters of their life, secure meaningful time with their children or have an agreement in place to protect their future leads to a real sense of fulfilment. Observing the members of the Family Law team at MFMac approach each matter with empathy and pragmatism has been a great learning experience.
As my time with the team comes to an end, I am grateful for the depth and breadth of experience I've gained. The work has reinforced the importance of empathy, adaptability and communication in delivering excellent service to our clients. Working alongside and learning from practitioners who are highly regarded in this field has been invaluable. I leave the seat with an appreciation for the unique nature of family law and with skills and experiences that I know will stay with me throughout my career.
