We are instructed by Thistle Wind Partners Limited on all aspects of the onshore elements (including the substation, cable route, and landfall) of the Ayre Floating Offshore Windfarm project.
Legal Services Provided
Our role is to secure the necessary land rights to enable the crucial onshore element of the project to be delivered. We are advising on the acquisition of land and rights by way of compulsory purchase and, potentially, necessary wayleave under the Electricity Act 1989 ("the 1989 Act"). This includes providing strategic advice on the underlying justification for any such acquisition in terms of site selection and environmental impact as well as advising in relation to biodiversity net gain.
Voluntary Land Rights Acquisition
In addition to compulsory acquisition, we are assisting with the acquisition of voluntary land rights by means of option for purchase and option for servitude. This includes negotiating and drafting option agreements, conducting due diligence on title, minerals, and crofting, and ensuring that all necessary legal documentation is in place to secure the land rights.
Planning and Environmental Advice
We are providing planning advice, including in relation to biodiversity net gain. This includes preparing and submitting applications for planning permission for the substation and cable route, conducting environmental impact assessments, and ensuring compliance with planning regulations. We are also advising on the environmental impact of the project and providing strategic guidance on mitigating any potential adverse effects.
Public Local Inquiry Representation
We will appear on behalf of the developer at any public local inquiry that may be scheduled to consider objections to the proposal. This involves preparing legal submissions, representing the client's interests, and advocating for the project's approval.
