David Hossack and Fiona Meek look at a recent employment tribunal decision which has attracted a significant amount of publicity, regarding an employee who was dismissed and discriminated against in light of her gender critical beliefs.
Following the Supreme Court judgment that the definition of "sex", "woman" and "man" under the Equality Act related to biological and not certified sex, the Equality and Human Rights Commission ("EHRC") is working to update relevant statutory and non-statutory guidance.
Injury to feelings awards can be made in discrimination and detriment claims brought before the Employment Tribunal. The award is intended to compensate a claimant for the hurt and distress suffered due to the unlawful action taken against them by their employer. They can be awarded whether or not any financial loss (such as loss of earnings) has been suffered.
